Acceptance of Terms
By accessing or using the Grand Dan service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.
Nature of the Service
Grand Dan is a prototype voice companion system designed to provide conversational interaction and scheduled audio announcements for a specific individual living with Alzheimer's disease. The service is provided as a research and validation prototype and is not a medical device, medical treatment, or substitute for professional medical care, supervision, or advice.
The AI assistant may provide inaccurate, incomplete, or fabricated information. Users and caregivers should never rely on the system for medical advice, emergency instructions, or critical decision-making.
User Accounts and Access
Caregiver accounts. Only authorized caregivers and administrators may create and use accounts. Each caregiver is granted access only to the persons they are authorized to support. Sharing account credentials or access with unauthorized persons is prohibited.
The person being helped. The individual the system is designed to support does not have a user account and does not register independently. All access is managed through authorized caregiver accounts.
Prototype authentication. The current prototype uses a device ID as a shared secret. Access granted via a device ID does not constitute a guarantee of security and is intended only for prototype evaluation.
Permitted Use
You may use the service only for its intended purpose: supporting the daily well-being of the registered person through voice conversation and scheduled audio cues. You agree not to:
- Use the service for any purpose other than its intended caregiving function.
- Attempt to access data for persons you are not authorized to support.
- Reverse-engineer, modify, or create derivative works from the service.
- Use automated systems to access or interact with the service.
- Share, sell, or distribute any data accessed through the service.
Caregiver Responsibilities
By using the service, caregivers agree to:
- Keep account credentials secure and notify the system administrator of any unauthorized access.
- Review alerts and conversation logs regularly.
- Not rely on the system as a replacement for in-person caregiving or professional medical supervision.
- Respond promptly to safety alerts (geofence exits, distress signals) through their normal care channels.
- Keep the registered person's information (name, family contacts, address) accurate and up to date.
Privacy
Your use of the service is also governed by our Privacy Policy, which describes how we collect, use, and protect personal data. By using the service, you consent to the data practices described in the Privacy Policy.
Intellectual Property
The Grand Dan system, including its software, design, and content, is the intellectual property of Two Rock Software, LLC. Nothing in these terms grants you any license to reproduce, distribute, or create derivative works from the system except as necessary for your authorized use of the service.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. GRAND DAN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE SERVICE IS A PROTOTYPE AND MAY NOT FUNCTION AS INTENDED AT ALL TIMES.
Grand Dan makes no warranties regarding the accuracy, completeness, or appropriateness of information generated by the AI assistant during conversations.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWO ROCK SOFTWARE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR OTHER HARM, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
In particular, Grand Dan is not liable for any harm resulting from:
- Failure of geofence alerts or other safety features.
- The AI assistant providing incorrect, misleading, or inappropriate information.
- Delays or failures in scheduled announcements.
- Caregiver reliance on the system in lieu of proper supervision or medical care.
Termination
We may suspend or terminate your access to the service at any time, with or without notice, for any reason — including violation of these terms. Upon termination, your right to use the service will cease immediately.
Changes to These Terms
We may update these Terms of Service at any time. Material changes will be communicated via email or through the service. Continued use of the service after changes constitutes acceptance of the updated terms.
SMS Communications
By providing a mobile phone number and opting in, you consent to receive SMS safety alerts (such as geofence exit notifications) delivered via Twilio. Message frequency varies based on alert activity. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of North Carolina, County of Orange, without regard to conflict of law principles.
